PostFinance Travel eSIM Terms and Conditions

Mindszi Technologies Ltd is the company behind this service. eSIM Copilot is our brand. We are registered in England and Wales, company number 15524190, at 128 City Road, London EC1V 2NX, United Kingdom.

1. Who we are and acceptance of these terms

1.1 PostFinance Travel eSIM, powered by eSIM Copilot, is provided by Mindszi Technologies Ltd, trading as eSIM Copilot ("eSIM Copilot", "we", "us"), company number 15524190, VAT number GB464150506, 128 City Road, London EC1V 2NX, United Kingdom.

1.2 Your contract for PostFinance Travel eSIM is with us, not with PostFinance AG. The PostFinance name and brand are used with permission. PostFinance AG is not a party to this agreement.

1.3 By buying or using a PostFinance Travel eSIM you agree to these Terms, our Privacy Policy and, where you buy for a business, our Data Processing Agreement.

1.4 If you do not accept these Terms, you must not use the service.

1.5 You must be 18 or over to buy a PostFinance Travel eSIM.

1.6 We may update these Terms. The version published on the PostFinance Travel eSIM website when you buy applies to that purchase. We will notify you before any material change takes effect.

Definitions used in these Terms: "eSIM" is the digital SIM profile we supply. "Plan" is the data allowance, coverage and validity period you buy. "Connectivity Partner" is a mobile network that carries your connection in the countries you visit. "Services" means the PostFinance Travel eSIM website, our WhatsApp service, the plans and the support that go with them.

2. The service

2.1 We supply prepaid travel eSIMs with mobile data in the countries shown for each Plan, together with the website, WhatsApp service and support that go with them.

2.2 Coverage, speed and performance depend on where you are, the networks available and your device. We cannot guarantee uninterrupted service.

2.2.1 You are responsible for checking that your device is eSIM compatible and not locked to another operator. We are not liable if your device cannot use the eSIM.

2.2.2 Some countries restrict or prohibit these services. We may refuse or restrict service in those territories.

2.3 PostFinance Travel eSIM is sold through the PostFinance Travel eSIM website and our WhatsApp service.

2.4 Plans are data only. They do not include calls or SMS unless the Plan says so, and they do not provide access to emergency numbers. You should maintain an alternative means of contacting the emergency services.

2.5 We may add, change or withdraw features. If a change materially reduces what you have already paid for, we will notify you and offer a refund of the unused portion.

2.6 Your eSIM is for your own use. You may not resell it.

3. Your account and how you may use the service

3.1 You must give accurate information when you register and keep it up to date.

3.2 You are responsible for safeguarding your login credentials and for activity on your account. Please notify us immediately if you believe that another person has gained access.

3.3 You must use the Services lawfully. You may not use them to break the law, to promote fraud or terrorism, to send spam, to hack or interfere with any network, or to resell connectivity.

3.4 Plans are intended for temporary or short-term roaming. Fair use limits may apply to keep the network stable. If your use materially exceeds normal usage patterns, we may review your account or suspend the service.

3.5 If you buy an eSIM and do not install or use it within three months, we will notify you by email. If it remains unused 14 days later, we may cancel it, and a new eSIM would need to be purchased.

3.6 You are responsible for any roaming or other charges your device incurs outside the Plan you bought, for example on your home operator's network.

4. Fees, payment, renewals and refunds

4.1 Prices are shown on the website before you buy, in Swiss francs, and include VAT unless stated otherwise.

4.2 You can pay by credit or debit card, Apple Pay or Google Pay. TWINT may also be available. By buying, you authorise us to charge your chosen payment method for the Plan.

4.2.1 Payments are handled by Stripe. We do not hold your card details, and payments are processed to PCI DSS standards.

4.3 A Plan runs for the data allowance and validity period shown when you buy it.

4.4 You can choose auto-renewal. Where you do, the Plan renews at the end of its term, each renewal is a new Plan charged at the price shown at the time, and you can switch auto-renewal off at any time before the renewal date.

4.5 Refunds are considered case by case. We will refund a Plan that could not be installed, or that did not work for a reason within our control, following investigation with you. We do not refund data that has already been used.

4.6 If we change prices, the new price applies to purchases and renewals made after the change.

4.7 If a payment fails or is reversed, we may suspend the Plan until it is settled.

5. Connectivity partners, intellectual property and privacy

5.1 Your connection is carried by our partner mobile networks in the countries you visit. We will assist you in resolving faults, but we are not responsible for failures in those networks that are outside our control.

5.2 We are not liable for losses caused by a Connectivity Partner's performance, beyond the remedies in clause 4.5 and clause 6.

5.3 We and our licensors own all intellectual property in the Services, including the platform, software and content. You get a limited, non-transferable licence to use the Services. You may not copy, reverse engineer or resell them.

5.4 The PostFinance name, logo and brand belong to PostFinance AG and are used with permission. Nothing in these Terms gives you any right to use them.

5.5 We handle your personal data as set out in the PostFinance Travel eSIM Privacy Policy. Where you buy for a business, our Data Processing Agreement also applies and forms part of this agreement.

5.6 When your account closes, we keep personal data as set out in the Privacy Policy. You may ask for earlier deletion.

6. Warranties, liability, termination and support

6.1 The Services are provided as is. To the extent the law allows, we give no other warranties, express or implied.

6.2 We are not liable for indirect or consequential loss, to the extent the law allows, and our total liability for any Plan is limited to the amount you paid for it. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

6.3 We may suspend or end your access if you break these Terms, if we are required to by law, or if a Connectivity Partner withdraws service. Where the suspension or termination is not due to your breach, we will refund the unused portion of your Plan.

6.4 You can stop using the Services at any time. Deleting your account does not refund a Plan you have already bought, except under clause 4.5.

6.5 Support is provided by eSIM Copilot, through chat on the website, on WhatsApp and by email at hello@esimcopilot.com. Our AI assistant is available at all times. Our support team is available Monday to Friday during European business hours, and requests received outside those hours are handled on the next business day. Standard requests are acknowledged within 24 business hours, and critical issues within 4 hours.

6.6 We aim for 99.9% platform uptime, excluding planned maintenance and events outside our control such as network outages. Planned maintenance is carried out outside peak hours and announced in advance.

6.7 If a claim is brought against us because you used the Services unlawfully or broke these Terms, you agree to indemnify us for our reasonable costs, to the extent the claim arises from your acts or omissions.

7. Force majeure, governing law and contact

7.1 We are not liable for delays or failures caused by events outside our control, such as natural disasters, war, industrial action or the failure of a public network. Our obligations are suspended while the event lasts.

7.2 These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

7.3 If a dispute arises, please contact us first. We will seek to resolve it within 30 days.

7.4 We are a member of CISAS, the Communications and Internet Services Adjudication Scheme, which is operated by the Centre for Effective Dispute Resolution and approved by Ofcom in the United Kingdom. If your complaint is not resolved, you may refer it to CISAS at cisas.co.uk.
